Jack Smith sent a scathing critique of the judge in Donald Trump’s case. In turn, Donald Trump has called for Smith to be censured by the court.
Donald Trump has often been the target of judicial rulings for his own criticism. As a private citizen, he has often been at the mercy of gag orders and prosecutorial misconduct with very little recourse. NBC News says:
Former President Donald Trump on Thursday said special counsel Jack Smith should be punished for issuing a scathing critique of a recent request for jury instruction proposals by the judge overseeing Trump’s classified documents case.
Smith “should be sanctioned or censured for the way he is attacking a highly respected Judge, Aileen Cannon, who is presiding over his FAKE Documents Hoax case in Florida,” Trump wrote in a post to his Truth Social platform. “He is a lowlife who is nasty, rude, and condescending, and obviously trying to ‘play the ref.’”
Some believe that Judge Cannon will be removed from the case by the 11th Circuit. While this would be to speed up the trial, it would inevitably delay it anyway. The Hill continues:
“I think that Jack Smith — I think the filing today makes it plain that she has to rule, and if she doesn’t rule under either scenario, they’ll be in a position to take her up to the 11th Circuit. And I think the 11th Circuit will likely take her off the case,” Cobb said.
Cannon recently instructed both sides in Trump’s documents case to propose jury instructions that would largely take into account Trump’s view of the Presidential Records Act (PRA), the law that dictates how records created during a president’s term must be handled and later archived. Cannon gave the instructions despite failing to consider Trump’s earlier motion to toss the case on those grounds.
Regardless of intent, the delay has been a positive development for Trump. If the trial happens just before the election, this will galvanize support for Trump. If it doesn’t and Trump wins in November, the trial will be delayed until after the end of the second term in 2029.
