Trump Wins Big Against Special Counsel

Trump has scored a huge win against Biden’s Special Counsel in the Supreme Court. The Court has denied prosecutor Jack Smith’s appeal to speed up his DC trial, which he had hoped would take place before the election.

This particular case against Trump revolves around January 6th. By expediting the trial, Smith and Biden hoped they could convict Trump before the election, all but ensuring Biden’s win. Politico reports:

The decision capped an extraordinary 48 hours that underscored just how the courts may be more pivotal to the campaign than debates and diners, and how the Justices, who find themselves with a jammed docket full of Trump-related cases, seem poised to affect the trajectory of the campaign as much as the candidates themselves.

“The campaign will be conducted in a courtroom, essentially,” said Dick Wadhams, a former Colorado Republican Party chair and longtime party strategist. “And that’s worked out well for Trump for the past year. They probably are banking on that to continue.”

Trump’s legal team is pushing for motions by the prosecutor to be appropriately run through the DC Circuit Court. This would further delay motions, though the DC Court has a Democratic heavy bench. Fox News quotes what the former President’s team said:

“This appeal presents momentous, historic questions,” the brief stated. “An erroneous denial of a claim of presidential immunity from criminal prosecution unquestionably warrants this Court’s review. The Special Counsel contends that it is of imperative public importance that respondent’s claims of immunity be resolved by this Court.’

“That does not entail, however, that the Court should take the case before the lower courts complete their review. Every jurisdictional and prudential consideration calls for this Court to allow the appeal to proceed first in the D.C. Court.”

Trump could delay the trial until after the election. If he wins but is later found guilty, it would trigger a huge Constitutional crisis that would test the nation’s democratic republic character.
